Terms of Service

1. Acceptance of Terms

By accessing or using AlcheGames, you agree to be bound by these Terms of Service (“Terms”) and all applicable laws and regulations. If you do not agree to these Terms, you must not access or use the Service. We may update these Terms from time to time, and your continued use of the Service after any changes become effective constitutes your acceptance of the updated Terms. These Terms are governed by the laws of the State of California, United States, without regard to conflict of laws principles.

2. Use of Service

AlcheGames provides an online platform where you can play HTML5 and other lightweight games, generate or remix games using AI models based on your prompts, and upload your own game HTML files (subject to review and technical limitations). Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business use. You are responsible for your own actions and content on the platform and must comply with all applicable laws and regulations when using the Service. We may modify or discontinue any part of the Service at any time, including experimental or beta features.

3. User Accounts

To access certain features, such as saving games, publishing content, or purchasing credits, you may need to create an account. You agree to provide accurate and complete information during registration and to keep your information up to date. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us promptly if you suspect any unauthorized use of your account or a security breach. Unless we explicitly approve otherwise, you may not create or maintain multiple accounts for fraudulent, abusive, or misleading purposes.

4. Credits and Payments

Certain actions on the platform, such as generating games with AI, may require virtual credits or other usage-based units (“Credits”). Credits may be granted for free (for example, for testing or promotions) or purchased with real money through third-party payment processors such as Stripe. By making a purchase, you authorize us and our payment processor to charge the selected payment method for the applicable amounts, including any taxes where required by law. Unless otherwise stated or required by law, all fees, subscriptions, and purchased Credits are non-refundable. If you subscribe to a recurring plan, you understand that charges will continue until you cancel according to the instructions provided in your account or on the website. We reserve the right to suspend or terminate access to the Service if we detect payment fraud, unauthorized use of payment methods, or excessive chargebacks.

5. Intellectual Property

The Service, including its software, design, graphics, trademarks, logos, and other materials (excluding user-generated content and certain third-party components), is owned by or licensed to AlcheGames and is protected by intellectual property laws. Subject to these Terms, you retain any ownership rights you have in the games and other content you create or upload (“User Content”). By submitting User Content to the Service, you grant AlcheGames a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, reproduce, display, perform, modify (for technical purposes), and distribute your User Content in connection with the operation and improvement of the Service, including presenting your games to other users. To the extent permitted by law and our AI providers, you may generally use the AI-generated output from your own prompts, but you are responsible for ensuring that such output does not infringe any third-party rights or violate any law.

6. Prohibited Activities

You agree not to use the Service for any unlawful, harmful, or abusive purpose. Prohibited activities include, without limitation: uploading or generating content that is illegal, hateful, harassing, defamatory, discriminatory, or otherwise objectionable; infringing or misappropriating intellectual property, privacy, or other rights of others; uploading malicious code or attempting to bypass security or sandboxing; scraping, reverse-engineering, or abusing the Service's APIs; using automated scripts or bots in a manner that overloads or interferes with the Service; and using AI prompts to request or encourage the generation of illegal, dangerous, or harmful content. We reserve the right, in our sole discretion, to remove content, limit functionality, or suspend or terminate accounts that engage in prohibited activities.

7. Termination

You may stop using the Service and, where available, delete your account at any time. We may suspend or terminate your access to all or part of the Service, with or without notice, if we reasonably believe that you have violated these Terms or applicable law, that your use poses risk or harm to us, other users, or third parties, or if we decide to discontinue the Service. Upon termination, your right to use the Service will immediately cease. Certain provisions of these Terms, including those relating to intellectual property, disclaimers, limitations of liability, and dispute resolution, will survive termination.

8. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. We expressly disclaim any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that any defects will be corrected, or that the Service will be free of viruses or other harmful components. You understand that AI-generated content may be incorrect, incomplete, unsafe, or inappropriate, and you should not rely on it as professional advice of any kind. You use the Service at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, AlcheGames and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for any loss of profits, revenues, data, or goodwill arising out of or in connection with your use of, or inability to use, the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages. Our total aggregate liability for any and all claims arising out of or related to the Service or these Terms will not exceed the greater of (a) the amounts you paid to us for use of the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD 100). Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

10. Changes to Terms

We may revise or update these Terms from time to time, for example to reflect changes in the Service, legal requirements, or business practices. When we make material changes, we will update the “Last updated” date at the top of the Terms and may provide additional notice, such as by email or through the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
